Terms of Service

These Terms of Service ("Terms") govern your use of the MyPollWorker Portal (the "Service"), operated by n-Tier Technology, Inc. ("n-Tier," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
MyPollWorker Portal is a poll worker management platform provided to county Boards of Elections in New York State. The Service enables Boards of Elections to manage poll worker recruitment, training, assignments, availability, and election day operations. Poll workers use the Service to apply, complete training, view assignments, and manage their election service.
2. User Accounts
To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information during registration
- Keep your contact information current
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
3. SMS Messaging Terms
By providing your mobile phone number through the Service and submitting your poll worker application, you consent to receive transactional SMS messages from the MyPollWorker Portal. These messages are operational and informational in nature.
Message Types
You may receive the following types of SMS messages:
- Authentication and login verification codes
- Poll worker assignment notifications and confirmations
- Training class reminders and schedule changes
- Election-day operational communications
- Scheduling updates and availability requests
Message Frequency
Message frequency varies based on election schedules and your poll worker activities. You may receive more messages during active election periods and fewer during off-seasons.
Costs
Message and data rates may apply. Please check with your mobile carrier for details about your messaging plan. We do not charge any fees for SMS messages sent through the Service.
Opt-Out
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a confirmation message and will no longer receive SMS messages from the Service. You may opt back in by replying START.
Please note that opting out of SMS messages does not affect your poll worker status or assignments. However, you may miss important notifications about your assignments and training schedule.

4. Acceptable Use
You agree to use the Service only for its intended purpose of poll worker management. You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other user accounts
- Interfere with or disrupt the Service or its infrastructure
- Submit false or misleading information
- Use the Service for political campaigning, marketing, or solicitation
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.
Your poll worker data is managed on behalf of your county Board of Elections. The Board of Elections is the data controller for your poll worker records, and n-Tier Technology acts as a data processor providing the Service on their behalf.
6. Intellectual Property
The Service, including its design, functionality, and content (excluding user-submitted data), is the property of n-Tier Technology, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any portion of the Service.
7. Service Availability
We strive to maintain the availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.
8. Limitation of Liability
To the maximum extent permitted by law, n-Tier Technology, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount paid by your county Board of Elections for the Service during the twelve months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by posting a notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
